A court case in Western Australia challenging mandates is lost
Ben Falconer, a police officer challenging the mandates in the Supreme court of Western Australia, lost his case this morning.
“I am not satisfied that the applicant has established the factual basis for his contentions,” Justice Jeremy Allenson wrote in his decision regarding the case against Chief Health Officer Dr Andy Robertson and the previous Police Commissioner Chris Dawson this morning (Tuesday 23 August 2022).
“All of the evidence establishes that the COVID-19 pandemic was, and remains, an extraordinary emergency.
“It was not, in the words of counsel for the applicant, a maelstrom in a petri dish. The measures that were taken are undoubtedly extraordinary, but that does not establish that they lacked rationality so as, for that reason, to be beyond power.”
Outside the court Falconer said a quote from Martin Luther King came to mind after the court’s decision, that the people had a “moral responsibility to disobey unjust laws”.
This is a big issue with bringing cases, because the precedent aspect of it (at least in the USA and how precedents work in the legal system here).
